In this recorded session, we discussed the proposed H-1B modernization rule, which will likely be published and take effect sometime in 2024. This rule seeks to redefine what it means to petition for an H-1B worker as USCIS seeks to make sweeping changes in the H-1B visa program for both employers and employees.
As background, a portion of this rule has already been implemented, notably the installation of the beneficiary-centric H-1B registration process for this year’s H-1B cap lottery. However, the full scope of this rule extends far beyond, reshaping the landscape of H-1B employment and introducing crucial changes that redefine key aspects of the process.
